The trial of 36 defendants, including terrorism suspect Ahlam Albashir, continued regarding the bomb attack on Taksim Istiklal Street on November 13, 2022, in which 6 people died and 99 people were injured. The hearing was held in the 14th High Criminal Court room due to the inadequacy of the Istanbul 13th High Criminal Court room. 5 detained defendants, including the defendant Ahlam Albashir, were brought to the court accompanied by the gendarmerie. Some detained and unarrested defendants were connected to the hearing via the Audio and Video Information System (SEGBİS).

The hearing began with the defense of the defendant’s lawyers against the opinion on the merits. Arguing that their clients had nothing to do with the incident, the lawyers requested the court to acquit their clients.

“WE HAD A DIALOGUE ONLY ONCE”

Fatma Berkel, one of the detained defendants who was given the right to additional defense due to the possibility that the crime of ‘possession of dangerous substances’ could turn into the crime of ‘procuring weapons’, argued that she did not know why Ahlam Albashir went to their house, that she was pregnant at that time and that she was not psychologically well. Defendant Berkel stated that there was only one dialogue between him and Ahlam, and that in this conversation he asked him why he came to Turkey, and Ahlam said that she came to live in Turkey, and requested his acquittal.

“I WISH THEY HAD KILLED ME AND NOT DONE THIS”

In his additional defense, the defendant Ferhat Habeş argued that he had never held a gun in his life, that he had nothing to do with the incident, and that he had nothing to do with the terrorist organization PKK. The defendant stated that he has been living in Turkey for 13 years, that he did not go to Syria during this time, that he opened his door to Ahlam Albashir and that they betrayed him, and said, “I wish they had killed me and not done this.”

Defendant Ahmet Carkes, in his additional defense, stated that he had no connection with the incident, that he took Ahlam Albashir from Esenler to the house where he would stay after being told that she had no one because he was a pirate taxi driver, and that was all he had to do with the defendants.

Defendant Ammar Jarkes, in his additional defense, said, “Today is Friday. I swear that I have nothing to do with this incident. I have been living in Turkey for 10 years. The only punishment I have received in 10 years is because of the seat belt. We fled our country because of the war. I came to Edirne without knowing that the person was a terrorist.” “When I returned home, I learned that my brother had been caught. If I were guilty, I would not have gone to the police station myself,” he said. The presiding judge, accompanied by a translator, asked the defendant whether he admitted the crime of immigrant smuggling. The defendant said that he admitted this crime, but did not accept the other charges.

The defendants, who were asked for their last words, demanded their release and acquittal. Some defendants cursed those who carried out the incident and asked for release.

HE WANTED TO TALK TO THE PRESIDENT OF THE COURT PRIVATELY

Defendant Ahlam Albashir, in his additional defense, said, “I will not defend myself. I accept any punishment that will be given to me due to the explosion incident and the deaths. Ammar Jarkes did not know anything. Ahmet Carkes did not know anything when he broke the phone. Ahmet Haj Hasan also stayed in his house for 3 days. “He helped me because we worked in the same workshop and he knew I had no one. These people have nothing to do with the case, I want to talk to the court president privately.”

DECISION HAS BEEN ANNOUNCED

Announcing its decision, the court convicted the defendant Ahlam Albashir 7 times in total, once for ‘disrupting the unity and territorial integrity of the state’, once for ‘intentional murder of a child by premeditated bombing’ and 5 times for ‘intentional murder by premeditated bombing’. He was sentenced to aggravated life imprisonment. The court sentenced the defendant Ahlam Albashir to a total of 1,782 years of imprisonment for the crime of ‘attempting to deliberately kill 99 people by premeditated bombing’, and to 12 years of imprisonment and a judicial fine of 22 thousand TL, with an increase for the crime of ‘possession of dangerous substances without permission’. The committee decided that there was no need to convict the defendant Albashir for the crime of ‘being a member of an armed terrorist organization’ and decided to continue his detention.

1035 YEARS OF PRISON FOR TWO DEFENDANTS SEPARATELY

The court sentenced the defendants Fatma Berkel and Ferhat Habeş to 18 years in prison separately for the crime of ‘aiding the unity of the state and the integrity of the country’, and sentenced both defendants to a total of 108 years in prison separately for the crime of ‘assisting in the deliberate killing of 6 people, including a child, who recorded their lives by bombing’. years in prison, 99 people were sentenced to 891 years in prison separately for the crime of ‘aiding an attempted intentional killing by premeditated bombing’ and 18 years in prison separately for the crime of ‘supplying weapons’. 17 YEARS OF PRISON SEPARATELY FOR 2 DEFENDANTS

Defendants Ammar Jarkas and Ahmet Carkes were sentenced to a total of 17 years in prison and a judicial fine of 60 thousand TL for the crimes of ‘immigrant smuggling’, ‘favoring the criminal’ and ‘destroying, concealing or altering criminal evidence’. The court acquitted both defendants of other charges. The defendant Hazni Göl was sentenced to 9 years in prison and a judicial fine of 60 thousand TL for the crime of ‘immigrant smuggling’. The court ruled that these defendants continue to be detained.

6 YEARS IN PRISON EACH FOR MIGRANT TRAFFICKERS

The court sentenced the defendants Hüseyin Güneş, Mahmud Elabid, Mahmud El Yusuf, Süleyman Güder and Tareq Alkhatip separately to 6 years in prison and a judicial fine of 30 thousand TL for the crime of ‘immigrant smuggling’. It ruled that these defendants were acquitted of other charges.

The court sentenced the defendants Bakar Carkes, Hadir Carkes, Hatice El Kurdi and Salih Carkes to 4 years in prison separately for the crime of ‘favoring the criminal’. The court acquitted the defendants separately on the charge of ‘disrupting the unity and territorial integrity of the state’.

12 DEFENDANTS WERE ACQUITTED
