The incident took place on May 15, 2022, in the park on İnönü Street in Kemalpaşa District. When high school student Kıvanç Uman became close to YK’s ex-girlfriend, a fight broke out between the two.

YK’s friends HMK and YA also participated in the fight. Uman, who fell to the ground with the blows of 3 people, was injured. Medical teams came to the region upon notice and took the injured young man to Izmit SEKA State Hospital. Uman, whose condition got worse, was later transferred to a hospital in Istanbul. Despite the interventions, Kıvanç Uman died in the hospital 4 days after the incident. YK, HMK and YA were arrested for the coup against Uman. YSK (15) and ABK (15) who were involved in the incident were released with a judicial control decision.

The 5th hearing of the case filed at Kocaeli 7th High Criminal Court as a juvenile court was held today. While the detained defendants attended the hearing via HMK and YA Audio and Video Information System (SEGBİS), the family and party lawyers of Kıvanç Uman, who was killed by YK, were present in the hall. ABK and Y.SK, who were tried without arrest. While he did not attend the hearing, only his lawyers were present in the hall.

The fight between Kıvanç Uman and the defendants and the statements of the audience were reflected in the video shot with a mobile phone camera. The video included in the court file showed the moments when Kıvanç Uman and the defendant YK were fighting, and after Kıvanç fell to the ground, YK hit him repeatedly. In the continuation of the video, in which the surrounding people say things like ‘Shoot him, shoot him’, ‘Get away from him’, ‘Blow him up’, ‘Hit him in the face’, ‘He has no strength left, hit him now’, ‘Knee him in the stomach’, and HMK’s Kıvanç Uman. There were images of him punching.

8 YEARS AND 9 MONTHS IMPRISONMENT FOR TWO DEFENDANTS, 3 YEARS AND 9 MONTHS FOR ONE DEFENDANT

At the recorded hearing, the court panel announced its decision about the defendants. The court ruled for HMK and YA, who were detained on trial for ‘deliberate murder’, stating that the action was ‘Aggravated wounding’ and that they should be sentenced to 12 years’ imprisonment, with a reduction of 8 years’ imprisonment due to the fact that they were 16 years old at the time of the crime. The court ruled that YK, who was on trial for the crime of ‘intentional murder’, was sentenced to 10 years in prison, stating that the action was ‘aggravated wounding’, and that it was committed under unjust provocation from the victim, based on his defense that could not be proven otherwise, and that a reduction be applied. The court, which decided to sentence him to 7 years and 6 months in prison, reduced the defendant’s life to 3 years and 9 months in prison because he was 14 years old. In addition, the case filed against YK for ‘Insult’ was dropped. The court acquitted ABK and YSK, who were tried without arrest for the crime of ‘incitement’.

THE PRESIDENT OF THE COURT AND THE MEMBER VOTED AGAINST

The presiding judge voted against the defendant YK. In the justification, it was stated that the YK cannot be held responsible for the death of the victim because there is doubt about the fatal blow to Kıvanç Uman, that the action should be evaluated within the scope of the crime of ‘Deliberate wounding’, and that this crime is subject to complaint and that the victim should be dismissed because he died without exercising his right to complain. .

The member judge stated that he fully agreed with the determination of the basic penalty in the ‘Aggravated injury’ decision against HMK, YK and YA. Stating that YK invited Kıvanç Uman to a duel and Kıvanç accepted this duel, the member judge stated that in the incident where YK and the other defendants who supported him collectively beat each other and fought, the hostility between them because of the girl issue and the insults they allegedly said to each other. He stated that YK, YA and HMK committed the crimes under provocation in the face of the video and their defense statements that could not be proven otherwise, and that he voted against HMK and YA because their sentences should not be reduced at a reasonable rate, although their sentences should be reduced at a reasonable rate separately. .

The member judge also said that the ABK and YSK were there as a crowd surrounding the victim, as evidenced by video footage and statements, and that they verbally encouraged the other defendants to beat the victim, cheered and applauded, and helped during the commission of the crime and facilitated its execution. He voted against, stating that they should be punished separately for the crime of ‘aiding’.

Kıvanç Uman’s mother, Derya Uman, who made a statement in front of the Kocaeli Courthouse after the hearing, had difficulty speaking. Derya Uman said, “My son has gone to the road of no return. My son was not an animal, he was human. I am proud of him, I always will be, but they will always be the mother and father of the murderer. They are always murderers. This stamp will not leave them. Let this world be theirs, but no one’s story is over. “We will appeal the decision.” he said.

Father Orhan said, “The life of a 15-year-old child cannot be this cheap. 8 years. Even for attacks on animals, people are punished more. A person died, a 15-year-old young boy. “This is where justice ends,” he said.
