Real estate expert Mustafa Hakan Özelmacıklı touched on the issues that should be taken into consideration for those who will give power of attorney in the land registry.

Özelmacıklı stated that many of the powers of attorney given today are erroneous and that caution should be exercised in this regard.

Explaining that power of attorney transactions are often done incorrectly and that a power of attorney is a contract in which the proxy undertakes to perform a task of the person giving power of attorney, Özelmacıklı said, “Since power of attorney is a contract based on conditions and mutual trust, the nature of the transaction to be performed should be clearly defined.”

Stating that notaries are the authorized institutions for issuing powers of attorney, Özelmacıklı stated that Turkish Embassies and Consulates can also issue powers of attorney for citizens living abroad.

He also stated that transactions by proxy are frequently carried out in land registry offices, but that risks should be taken into consideration in this regard.

Specialmacıklı, who warned about giving incorrect powers of attorney, stated that the limits of authority of powers of attorney should be specified and that they should be given only for a specific immovable property and for as long as possible. He stated that otherwise, undesirable situations may be encountered with a given power of attorney.

Providing information about the issues sought in powers of attorney, Özelmacıklı stated that the format of the power of attorney should be such that it can be used in land registry or cadastre directorates.

He also informed that the name, address, signature and seal of the person issuing the power of attorney, as well as the place, date and journal number of the power of attorney should be included.

Making statements about authority, Özelmacıklı said that the power of attorney should include the transactions necessary to carry out the main transaction.

He stated that unless there is a contrary provision in the power of attorney, it includes the registration of the sales authority and the receipt of the price.

Providing information about the reasons for the termination of the power of attorney, Özelmacıklı explained that the power of attorney relationship can be terminated for various reasons unless otherwise stated between the parties.

He stated that these include situations such as death, bankruptcy, resignation and expiration of time, and added that dismissal from power can occur in various ways.
