In the decision of the Ankara Chief Public Prosecutor’s Office, it was stated that it was understood that the complainant turned this situation into a “profession” and that he insulted himself and benefited from it. It is possible to take action or be attacked in social media posts. People who have been insulted need to apply to the judiciary. However, there are also those who turn this situation into income. Prosecutor Ahmet Özel, working at the Ankara Chief Public Prosecutor’s Office, made an important decision regarding the abuse of rights. Prosecutor Özel rejected the request, taking into account that the complainant was a plaintiff in many defamation cases. In his decision, Özel first underlined that the complainant had made insulting himself a profession.
Prosecutor Ahmet Özel highlighted the following points in his petition:
There are many similar files that the complainant has already complained about.
He enables other users to insult him with his social media posts.
It tries to benefit itself by pushing users to these actions.
Prosecutor Özel rejected the complaint petition with the decision that “there is no need to prosecute on behalf of the public.”
